Shariat courts have no legal sanctity: Supreme Court

In its landmark judgement on Monday, the Supreme Court has said that Sharia courts have no legal power and cannot issue fatwas against individuals which affects his or her rights.

While hearing a PIL challenging the functions of Sharia courts, the Court said, “No religion is allowed to curb anyone’s fundamental rights.”

The petitioner, Vishwa Lochan Madan, had argued that Shariat courts are illegal and it operated as parallel courts in India, deciding on religious and social freedoms of Muslim citizens. He said fundamental rights of Muslims should not be controlled or restricted by fatwas issued by qazis or religious heads appointed by Muslim organisations.
