In a landmark decision today, the Supreme Court of India has constituted a five-judge bench who will preside over the petition on Section 377 which criminalises homosexuality.
The bench headed by Chief Justice TS Thakur reopened the legal debate on homosexuality which will hear 8 petitions filed by gay rights and LGBT activists and NGO Naz Foundation against the Supreme Court’s 2013 judgement on section and simultaneous dismissal of review petitions in 2014.
In the petition the activists urged the court to look into its earlier verdict on article 377 of IPC which resulted violation of fundamental rights to the LGBT community.
“The judgement was reserved on March 27, 2012 but the verdict was delivered after around 21 months and during this period lots of changes took place including amendment in laws which were not considered by the bench which delivered the judgement,” the plea had said.
